Alert for Green Card Holders with Post-1998 Convictions

The American Immigration Lawyers’ Association (AILA) posted an alert that the U.S. Customs Border Protection at Newark Airport (New Jersey) has adopted a mandatory detention policy for U.S. lawful permanent residents that have criminal post-1998 convictions. The new policy authorizes the detention of returning lawful permanent residents for up to twenty four (24) hours to obtain a copy of conviction record.

Similar policies were implemented in Georgia and Florida, and it should be noted that such policies may be expanded into other airports at any time. Therefore, it is strongly recommended that you contact your immigration attorney before making any flight arrangements.
